Fox JM did not determine the CPI rent increase issue in the earlier proceedings, so issue estoppel did not arise. However, the present rent shortfall claim was intimately connected with and arose substantially out of the same facts as the earlier proceedings, had been raised but not properly pursued then, and could and should have been litigated at that time. An Anshun estoppel therefore precluded the Applicant from claiming any rent shortfall for the period from 17 April 2001 to 23 September 2002.
