Kekatos v Stafford [2009] NSWCA 219

The court held that, notwithstanding the express terms of assignment, the appellant was estopped in equity from denying the respondents a 50% beneficial interest in the Global Charge and its proceeds, as the assignment was undertaken and relied upon with the mutual expectation of a trust, induced by the appellant’s conduct. The failure of the underlying joint endeavour did not invalidate the assignment, and relief lay in holding the appellant to account for the proceeds as trustee, proportionately, after reimbursement of expenditures.
