However, risk of injury to persons was found to be low, and damage by T2 was unsubstantiated. Accordingly, orders to repair existing gutter damage and prune low branches of T1 are appropriate, but removal of the trees is disproportionate and unnecessary.

  • The respondents, at their expense, shall engage AQF level 3 arborists to prune the two lowest branches from T1 growing towards Ms Kwan's side neighbour's land, to their branch collars.
