The applicant was not usually resident in the People's Republic of China immediately before his entry into Australia, as required by cl 850.213(d) of Sch 2 of the Migration Regulations. At that time he was voluntarily resident in Hong Kong, which the Tribunal and the Court found to be a 'country' separate from the PRC for the purposes of the relevant Regulations. There was no error in the Tribunal's failure to engage with the question of voluntariness as the evidence showed voluntary residence in Hong Kong, and no jurisdictional or legal error was demonstrated.
