Procedural Posture

Application Under Part IV of the Trustee Act 1925 (nsw) / Principal Judgment

  1. 1 Whether the applicant is entitled in equity to the whole of the funds paid into court by Westpac after the sale of the property owned as joint tenants with Ms Young
  2. 2 Whether a declaration should be made recognising the applicant's equitable ownership of the proceeds of sale

Ratio Decidendi

The applicant made the sole financial contribution to the purchase of the property and mortgage repayments; Ms Young made no contribution. In equity, joint tenants hold the property proportionate to their contributions unless displaced by advancement or shared intention. As no such displacement occurs here, the proceeds of sale held by Westpac after sale by mortgagee are held on constructive trust for the applicant solely. The applicant is therefore entitled to the entirety of the funds paid into court.
