Westpac Banking Corporation v Billgate Pty Ltd [2013] NSWSC 460
The court has discretion under UCPR r 33.8 to make directions regarding all documents produced following service of a subpoena, and is not limited only to documents strictly within the ambit of that subpoena. Since there is no dispute that the documents are or may be relevant to the issues in the proceeding, returning them would be inconsistent with the overriding purpose in s 56 of the Civil Procedure Act. Therefore, all produced documents are to be made available for inspection by all parties.
