The Children's Court of New South Wales had no jurisdiction to make an order for maintenance against the appellant as the complaint alleged that the wife had been left without support in Victoria, not New South Wales. This lack of jurisdiction appeared on the face of the complaint, and thus on the face of proceedings. The appellant was entitled to a writ of prohibition as of right.
