The Court preferred Mr Karras' evidence, found it more probable that the Applicant told Mr Karras to 'stick the job up his arse', and concluded that the Applicant abandoned his employment after the Respondent legitimately refused to pay for unaccrued and unauthorised leave. The application under s170EA therefore lacked jurisdiction and had to be dismissed.
