McDermid v Repatriation Commission [2016] FCA 372
Prior to 15 September 2011, s 74 of the VEA did not apply to the applicant as there was not sufficient symmetry between the incapacity paid for under the SRC Act and the defence caused injuries for which pension was paid. Determinations to reduce the applicant's pension were legally erroneous. From 15 September 2011 (the date of amendment), s 74(2) applied based on sameness of incapacity rather than injury, so the compensation offset operated lawfully until the compensation payments ceased at age 65.
