The proof of debt lodged by the Commonwealth Bank of Australia was wrongly admitted and should be expunged because the Bank, by making an agreement with AGC for the disposition of sale proceeds without the applicant’s consent, could not seek to recover from the applicant a shortfall arising from its own arrangement. The allocation of sale proceeds violated the statutory scheme and the applicant could not be liable for amounts representing the Bank's voluntary allocation to AGC beyond its security.
