William Siu v Rui Fen Li [2011] NSWSC 1453
Although the proposed cross-claim was very late and the delay was not adequately explained, it had the potential to affect the outcome of the proceedings and refusing leave could have significant adverse consequences for Ms Li. The interests of justice therefore required leave to file it. Because the cross-claim raised new issues that Mr Siu could not reasonably investigate before the imminent hearing, the hearing date had to be vacated. As the late application was not caused by any fault of Mr Siu and his opposition was reasonable, Ms Li was ordered to pay the costs thrown away by the late filing and vacation, and the costs of the motion.
