Williams v Spautz [1992] HCA 34

A permanent stay of proceedings can be granted in the exercise of the court’s inherent jurisdiction to prevent abuse of process where the proceedings have been instituted and maintained for a predominant improper purpose, regardless of whether an improper act has been committed or whether the proceedings could otherwise be conducted to conclusion. The core test is whether the predominant purpose for instituting proceedings is collateral and outside the scope for which the process exists.
