The proposed residential flat building could not be approved because objections by occupiers of units 13 and 63 at No 88 Wycombe Road were well-founded under cl 14A(1)(b), principally due to substantial harbour view loss. The proposal also failed cl 13 because parts exceeding the building height plane would materially obstruct views and increase overshadowing, objections had been raised, and no SEPP 1 objection addressed cl 13. The Court was not satisfied that the height non-compliance should be excused, and development consent was therefore refused.
