The claims against the Council in the District and Federal Courts were not the same matter as there was no common substratum of facts, the causes of action arose at different times, and the type of damage alleged differed (economic loss vs physical damage). The Federal Court did not have jurisdiction over the District Court claim; there was therefore neither cause of action estoppel nor Anshun estoppel barring the proceedings.
