Procedural Posture

Application for Security for Costs / Interlocutory Decision

  1. 1 Whether security for costs should be ordered under section 1335 of the Corporations Act 2001 (Cth) and rule 42.21 of the Uniform Civil Procedure Rules 2005 (NSW)
  2. 2 Quantum and timing of security to be provided

Ratio Decidendi

The court exercised its discretion to order further security for costs, finding the proceedings sufficiently complex and the estimates of quantum provided by defendants more realistic. The plaintiff had not demonstrated that provision of additional security would stifle litigation or that the low estimates were appropriate. Accordingly, security was ordered in addition to the existing bank guarantee.

Court Disposition
