The appeals officer erred in treating one worker as an arm's-length comparable; the evidence showed the two executives controlled and acted in concert with the appellant and were not dealing at arm's length, and based on the salary, duration, nature and importance of their work they would not have entered into substantially similar employment contracts at arm's length; therefore their employment is excluded and the Minister's decision that they held insurable employment is vacated.
