On the balance of probabilities the Court found the vehicle was acquired primarily (and effectively exclusively) for the principal shareholder's personal use, the appellant failed to prove commercial primary use or that adequate consideration equal to fair market value was paid for personal use, billing entries were not paid and kilometrage records were unreliable; therefore the ITC is disallowed under s.199(2) and excluded by ss.170(1)(b) and (c) of the ETA.
