R. v. Sparks

Applying principles of identification and joint enterprise, the Crown proved beyond a reasonable doubt that the accused were present, formed an implied common intention to engage in an assault in response to a call for backup, and that in the course of that agreed assault their combined conduct of kicking, punching and stomping on the helpless victim would probably wound or endanger life; s.21(2) therefore makes each of them guilty of aggravated assault even though individual blows cannot be attributed to specific accused. The evidence was insufficient to prove aiding and abetting under s.21(1).
