For purposes of s.39 of the Supreme Court Act the amount in controversy includes the principal and the interest on the trial court's judgment accruing up to the date of the appellate court's judgment; that inclusion governs jurisdiction and applies whether the appellate court affirms or reverses the trial judgment, therefore the Court had jurisdiction and the appeal was allowed.
