The court allowed the appeal and set aside the partial summary judgment because the motion judge erred in principle and made palpable and overriding errors: she failed to require an affirmative finding that the issues could be bifurcated without material overlap before granting partial summary judgment, and she misapplied the modified objective discoverability test by imputing subjective attitudes of Mr. Schuurman to the hypothetical reasonable person; these errors warranted reversal and setting aside of the partial summary judgment and related costs order.
