Although fraud involving an elderly victim and breach of trust normally attracts custody, the judge found that the combination of factors—first time offender, guilty plea, mental health and financial stressors, caregiver responsibilities, progress in treatment and supportive circumstances—constituted exceptional circumstances such that a suspended sentence with 12 months probation and a restitution order appropriately satisfied denunciation, general deterrence and rehabilitation.
