On the evidence the court was satisfied beyond a reasonable doubt that Saviz Rezaie had knowledge of and a measure of control over the cocaine based on his physical proximity to the drugs, large amounts of cash on and near him inconsistent with legitimate sales, and supporting surveillance evidence linking the store to crack sales; conversely, the Crown did not discharge its burden with respect to Ashkan Bahmani-Mozafar because there was reasonable doubt arising from lack of physical proximity or incriminating items on him, evidence that he refused an undercover request to sell drugs, and insufficient proof of his knowledge or control.
