On the balance of probabilities the court found that Mubin acquired a beneficial interest in the property in 1988 (partly by advance of future expectations and by assuming mortgage obligations) and that the 1991 conveyance to Jainab did not rebut that resulting trust; accordingly 50% of the property is held in trust for the estate of Mubin Mohammed Khan (tenant in common) and the remaining 50% belongs to the Estate of Jainab Khan. The court did not need to and did not decide on fraudulent conveyance or constructive trust grounds.
