Given the penetration sexual assault of an intimate partner who was in a vulnerable state, and weighing aggravating factors (intimate partner, vulnerability, penetration) against mitigation (lack of relevant record, sobriety efforts), the appropriate sentence is at the bottom of the established 2-6 year range; a two-year federal custodial sentence is imposed together with ancillary orders (10-year SOIRA, DNA sample order, 10-year firearms prohibition), and a Conditional Sentence Order is not appropriate in these circumstances due to the need for denunciation and deterrence under s.718.04.
