R. v. Vlachias
On the evidence (video, admissions, medical reports and expert opinion) the Crown proved beyond a reasonable doubt that the accused undressed, transported and repeatedly sexually touched/intercourse‑type conduct with an unconscious complainant (sexual assault under s.271) and that, being under a legal duty from the time he took her into his charge, he failed to seek urgent medical assistance in circumstances that objectively endangered her life and amounted to a marked departure from reasonable conduct (s.215(2)).
