Fidelity-Phenix Fire Insurance Co. of New York v. McPherson
Because the appellant had not given security for the judgment debt and costs as required by s.76(d) of the Supreme Court Act, a judge of this Court could not stay execution of the money judgment; control of execution in that circumstance rests with the court appealed from. However, this Court can stay further proceedings in this Court pending presentation of a petition for leave to appeal to the Judicial Committee of the Privy Council upon an undertaking by the appellant to present such a petition.
