Greenbank v. The National Supply Co.

The plaintiffs were entitled in equity to the estate dividend/trust fund to the extent of the unpaid balances of their mechanics' liens because the committee had reimbursed itself from production for completion costs and the estate dividend (proof) received by the committee was, to the extent of plaintiffs' claims, held and applied in trust or by subrogation for those lienholders; paying the committee would otherwise reduce its reimbursed costs and thereby enlarge the surplus to which the plaintiffs' liens attached.
