The Crown proved beyond a reasonable doubt the elements of s.335(1): the accused intentionally took Zoey Francis’s motor vehicle and did so without her consent and without an honest belief in consent; therefore the accused is guilty of taking without consent. There was insufficient evidence to prove who drove the vehicle into the ditch, so that allegation was not proven.
