The application judge's oral denials were set aside for inadequate reasons; the direct indictment was valid under Criminal Code s.577 permitting written consent of the Deputy Attorney General; the existing detention order continued to apply to the new indictment under s.523(1.2); jurisdictional and constitutional challenges were inappropriate for resolution by habeas corpus on the incomplete record and should be addressed at trial or a properly constituted bail review; accordingly the matter was remitted for an immediate new bail review and the habeas corpus application was adjourned pending that review.
