Given the urgency of foreclosure proceedings threatening the last significant estate asset and the conflict of interest and conduct of the appointed trustee, the court exercised its power under Rule 22-5(6) and s.31 of the Trustee Act to set aside the joinder and to remove Mr. Whittaker as executor/trustee of the Cultus Lake property and to appoint Ms. Stevens as interim executor/trustee of that property for the limited purpose of defending the foreclosure and preserving the asset pending trial.
