The amended federal deemed trust provisions (ITA ss.227(4),(4.1); EIA ss.86(2),(2.1)) unequivocally impose an obligation on secured creditors to pay proceeds of property subject to the trust to the Receiver General in priority to their security interests; these federal provisions supply the cause of action and remedy (including recovery under ITA s.222) and are not displaced by provincial suppletive procedure, therefore respondents who received sale proceeds without remitting them are personally liable to pay those amounts to the Receiver General.
