Procedural Posture

Judicial Review / Motions Stage (stay, Direction, Leave to File Affidavit); Proceeding Pending Determination of Judicial Review a 219 16

  1. 1 Whether the Canadian International Trade Tribunal's recommendations take immediate effect and must be implemented by the government institution
  2. 2 Whether the Attorney General is entitled to a stay of the Tribunal's recommendation pending judicial review
  3. 3 Whether Public Works must pay the compensation recommended by the Tribunal pending the outcome of judicial review

Ratio Decidendi

The Attorney General failed to demonstrate irreparable harm with particularized evidence; speculative assertions about funds being irrecoverable were insufficient. Consequently the stay motion failed. Because Public Works indicated it would implement the Tribunal's recommendations subject to judicial review and Oshkosh provided assurances (including an undertaking from its parent), the Court directed implementation/payments if no stay is granted. The Court refused leave under Rule 312 to file an additional affidavit because the evidence sought to be adduced was merits-based, should have been before the Tribunal, and could have been obtained with due diligence.

Court Disposition

Attorney General's motion for a stay dismissed; Oshkosh's motion for direction that Public Works comply with Tribunal recommendations granted (subject to judicial review outcome); Attorney General's motion for leave to file an additional affidavit dismissed; ancillary directions on record and scheduling to be...
