Ratio Decidendi

Section 91(4) of the SABS validly deems a regular company driver who is living and ordinarily present in Ontario to be the named insured under the company policy for the purpose of payment of statutory accident benefits; because Hounsell was thus a named insured under the Boreal policy and was an occupant of the insured automobile, Boreal (insurer of the tractor) has priority under s.268(5.2) and must pay the accident benefits. The regulation is authorized by s.121(1)9 of the Insurance Act.
