The Court of Appeal upheld the Panel’s decision as reasonable: s.98(7) must be read consistently with s.98(6) and s.100(3) so as not to permit 'backdoor' certifications; the Industrial Agreement’s sectoral clauses could not bind Nova Scotia Power to construction Locals that had not acquired bargaining rights under s.98(6); 'non-union employee' in s.98(7) was reasonably interpreted to mean a person who belongs to no union; and on the facts the Panel permissibly found abandonment/estoppel based on long standing past practice and inaction by the construction parties — therefore the appeal was dismissed.
