Ratio Decidendi

The appeal was dismissed because the motion judge properly exercised his power to grant summary judgment for HRI; the cause of action was discovered only when HRI learned of the sale so the limitation period had not expired; and even if title had passed to the Town under the lease, the Town was obliged to apply the proceeds to rent arrears and to sell at a reasonable price under s.53 of the Commercial Tenancies Act.
