The Minister was entitled to reassess beyond the normal reassessment period under s.152(4)(a)(i) because the persons who filed the return (the executors) did not exercise the reasonable care required of a prudent person in reviewing and filing the terminal return, so the omission of CCA recapture constituted a misrepresentation attributable to neglect; independently, the Court accepted the appellant expert valuation and found the respondent's expert unreliable, fixing the FMV of the Wilson property at $8.6 million and adjusting the value of Leadway shares accordingly.
