Leave to have the chambers dismissal reviewed by a panel was granted because appellants produced fresh, corroborated evidence (counsel's affidavit of incapacitating mental health issues) that was not before the chambers judge, the appeal has arguable merit, and there is a reasonable possibility that the fresh evidence would have led the chambers judge to a different outcome; accordingly a panel review is necessary to prevent an injustice under Rule 90.38(6)(c).
