Procedural Posture

Employment Insurance Act Appeal / Trial and Judgment (reasons Delivered)

  1. 1 Whether employment was insurable for related parties under s.5(3)(b) of the EIA
  2. 2 Whether non-related appellants were in fact engaged in insurable employment and how many insurable hours/insurable earnings to recognize
  3. 3 Reliability of payroll records, picking cards and daily logs

Ratio Decidendi

Related-party claims (the two family-claimants who were partners’ spouses) were excluded from insurable employment because the Tribunal was not satisfied the parties would have agreed substantially similar arm’s-length contracts; for non-related claimants the Minister’s alternative recalculation method (using forensic audit, industry norms and Insurable Earnings Regulations) was adopted and adjusted by the Court where evidence justified modest increases (15%) and limited task-specific multipliers (netting doubled, irrigation days increased) to reach final insurable hours and earnings for each claimant.
