Dalrymple Insurance Agency Ltd. v. Peter

Dalrymple Insurance Agency Ltd. v. Peter

When a minimum retained premium is set equal to the annual premium, a party charged with that premium is entitled to the benefit of year‑long coverage; if the broker cancels mid-term and the insured only received approximately six months of coverage, the insured is liable only for the proportionate premium for the coverage actually provided. Therefore the claim for the full annual premium was reduced by half.

  3. 3 How minimum retained premium operates when it equals the annual premium in a seasonal risk context

Ratio Decidendi

When a minimum retained premium is set equal to the annual premium, a party charged with that premium is entitled to the benefit of year‑long coverage; if the broker cancels mid-term and the insured only received approximately six months of coverage, the insured is liable only for the proportionate premium for the coverage actually provided. Therefore the claim for the full annual premium was reduced by half.
