On an interim application the court applied the Divorce Act best interests and maximum contact principles, found both parents to be fit and loving caregivers based on evidence including adoption agency reports, concluded the previous Wong J. order was temporary and variation did not require a material change, and therefore ordered joint custody and guardianship with a modified parenting schedule increasing the father's weekly contact to better effectuate maximum contact while promoting stability and allowing liberty to apply after the scheduled trial date.
