The Federal Court of Appeal upheld the Federal Court: on the reasonableness standard the adjudicator/referee reasonably concluded that numerous and unexplained errors in 1997 sales reports undermined the Bank’s trust and justified dismissal for cause; the monetary claims failed because documentary proof was lacking and the adjudicator’s evidentiary requirements were within his procedural powers; the alleged derogatory comments did not give rise to a reasonable apprehension of bias. Therefore the appeal is dismissed.
