Applying Quebec civil law and the relevant indicia of subordination, the Court found that, on the objective facts, the majority of the contracts were contracts for services (independent contractors) because teachers retained freedom to determine course content with students, were engaged course-by-course, provided little investment, and lacked juridical subordination; the CBC contracts and one Agropur factory contract were closer to the line but, on balance, still constituted contracts for services to achieve the client’s specified result; accordingly the Minister’s determinations of insurable employment (and pensionable employment for Dalia El Mourad) are vacated and replaced as specified.
