The actus reus elements of s.106F include the existence of another traffic lane and the accused's ability to move safely into it; those external circumstances are for the Crown to prove beyond a reasonable doubt. Section 794(2) did not apply to convert those elements into a defence burden. Classification as a strict liability offence does not shift the persuasive burden for actus reus; therefore the adjudicator properly acquitted on reasonable doubt and the acquittal is reinstated.
