Because the action continues and the appellant achieved partial success on the summary judgment appeal, the Court reduced the summary judgment motion costs from $35,000 to an all-inclusive $10,000 and held that Ontario and the Children’s Aid Society are not entitled to costs of the action; the contempt motion costs of $7,500 were left undisturbed; on the appeals the Children’s Aid Society was awarded all-inclusive partial indemnity costs of $3,500 for the contempt appeal and $1,500 for the summary judgment appeal, with no costs ordered between the appellant and Ontario.
