Dowling v. Dowling
Because there was uncontested evidence of a substantial history of physical, sexual and psychological family violence by the respondent, the claimant's fear was reasonable, and the risk of recurrence in the context of ongoing acrimonious litigation was more than a mere possibility, the court was satisfied family violence was likely within the meaning of s.183. Accordingly the March 28, 2023 protection order was renewed on the same terms to protect the at‑risk family member.
