A 'place of origin' under s.12(1)(b) of the Trademarks Act includes any geographical designation, including designated lines of latitude; NORTH 42 DEGREES is such a geographic designation describing the origin of the Applicant's goods and services and therefore is clearly descriptive under s.12(1)(b), rendering the trademark unregistrable; the TMOB erred in narrowing 'place of origin' to named places and in imposing an evidentiary burden on the Opponent to define that legal term.
