The appeal was dismissed because even if the pistols could be considered designed exclusively for blanks, s.84(3)(b) also requires that the possessor intend exclusive use for blanks and the trial judge found, supported by evidence, that the appellant knew the purchaser intended to convert the pistols; therefore the deeming provision did not apply and the appellant had mens rea for the s.99/s.100 offences. The judge's interjections were harmless and did not affect fairness.
