Ratio Decidendi

Although the appeal was not found to be frivolous or vexatious, the combination of unchallenged trial findings of serious fraud and findings that the appellant had taken steps to protect assets from creditors, together with evidence that the appellant is impecunious and that equity in principal assets is frozen, constituted a compelling "other good reason" under Rule 61.06(1)(c) to require security for costs; $75,000 was just and proportionate in the circumstances and must be posted within 45 days before perfection of the appeal.

Orders
