By analogy to the Rules and the Federal Court Act, an interlocutory appeal lies from an interlocutory order of a referee; however a referee lacks power to vary the terms of the order that created the reference; here the referee's requirement that notice be given varied the May 10, 2002 ex parte order of McGillis J. and thus exceeded the referee's jurisdiction, so the motions judge's and referee's orders were set aside and the reference ordered to proceed ex parte.
