On appeal the Court of Appeal allowed the appeals of Dr. Padmore and The Scarborough Hospital because the trial judge's legal-causation analysis was legally flawed and the finding of direct hospital liability exceeded the issue posed by parties and lacked requisite analysis; accordingly judgments against Padmore and the Hospital were set aside and actions dismissed. The appeal of Dr. Jamensky was dismissed: the trial judge's findings that conversion to general anesthesia before exhausting reasonable alternatives and resulting anesthetic complications caused the cardiac arrest were supported by the evidence and not reversible.
